Conditions of Carriage

A. Ownership
The Central Tramway is owned and operated by The Central Tramway Company Scarborough Ltd.
B. Operator’s Mission
To transport passengers between the Top Station (Marine Parade) and the Bottom Station (Foreshore Road) in such safety and comfort as the historic equipment will allow, enabling such passengers to enjoy the experience of travelling on a Victorian funicular railway and to enjoy the beauty of the surrounding scenery.
C. Operator’s responsibilities
These include:
a) Ensuring that the lift is clean, maintained in good working order and is compliant with current relevant legislation.
b) Treating passengers fairly and with respect.
c) Ensuring that prospective passengers have the opportunity to check the cost of their journey before they start that journey.
d) Ensuring that passengers are made aware of any information necessary to ensure their comfort and safety, including any regulations with which they must comply during their journey.
e) Advising prospective passengers of the acceptable methods of payment of the fare.
f) Ensuring that all queries and complaints are dealt with promptly.
D. Passengers’ responsibilities
1) All passengers must comply with these Conditions of Carriage.
2) Passengers must not travel or attempt to travel without the intention of paying the requisite fare when required to do so nor do so without the means to pay that fare.
3) Passengers must follow any instructions staff give regarding safety and comfort (or the safety and comfort of other passengers) when boarding, travelling on or leaving the carriages.
4) Passengers must be respectful of other passengers, operator’s staff and facilities. Otherwise prospective passengers may be refused travel or asked to leave the operator’s premises.
5) In particular, passengers must not:
a) Smoke at any time - this includes cigarettes, e-cigarettes, cigars and pipes. This restriction applies equally to the lift carriages, stations and outdoor areas.
b) Behave in any way which causes offence to other passengers or the operator’s staff - this includes verbal or physical abuse; being under the influence of alcohol, drugs or solvents; wearing soiled or dirty clothing; putting your feet on seats; consuming and playing personal or other music systems too loudly.
c) Wear swimwear, especially wet garments.
d) Take any open food or drink (alcoholic or otherwise) container into the carriage nor consume any item of food or drink in the vehicle.
e) Distribute, offer for sale or solicit for any items without prior permission – this includes collecting for charity.
f) Deliberately interfere with, misuse or damage any equipment or fittings forming part of the carriage.
g) Enter or try to gain access to those areas of the installation that are not normally open to the public. 
h) Take part in any criminal or legally prohibited activity.
6) Passengers must keep their possessions with them at all times when on the premises so as to prevent an unnecessary security alert and should report any unattended packages to the operator as soon as possible
E. People with disabilities
1) People with disabilities will, as far as reasonably practicable, be treated in the same way as those without those disabilities, including charges for travel.
F. Children and young people
1) Children under the age of 9 will not be carried unless they are accompanied by an adult.
2) Parents or guardians should keep all children under 9 with them at all times.
G. Wheelchairs
1) People in wheelchairs and any associated carers must follow the instructions of the operator for access, loading or unloading so that this can be achieved in the safest and most efficient way.
H. Mobility scooters
1) The Central Tramway was built before the age of mobility scooters, hence the carriages were not designed to carry such vehicles. However, the Operator is prepared to offer a service to such vehicles, on the understanding that any damage caused by the said mobility scooter to other passengers, staff or property is the sole liability of the driver of the vehicle.
2) All mobility scooters must engage their parking brake throughout the ride.
I. Freight
1) It is prohibited to carry the following articles on the Central Tramway; 
a) Fuel or flammable liquids;
b) Pressurised gas containers or aerosols – regardless of whether the contents are explosive or inert;
c) Fireworks or pyrotechnics;
d) Biological hazards;
e) Acids or other corrosive liquids;
f) Radioactive materials;
J. Closed circuit television
1) The Central Tramway Company deploys Closed Circuit Television (CCTV) throughout its premises.  Images are recorded for the purpose of crime prevention, detection, legal proceedings and public safety. Images of alleged offenders may be passed to the police and be used in a court of law.
2) Anyone deliberately attempting to conceal their identity from any such camera may be asked to leave the premises.
K. Photography
1) The operator wants passengers to enjoy their experience on the lift and the operator appreciates that part of that enjoyment is taking pictures and sharing them with others. The operator is happy for passengers to take pictures before, during and after their journey as long as they are for their personal enjoyment, which includes sharing them on social media.
2) Please ask the people concerned before taking pictures of the operator’s staff.
3) Please ask permission from staff before taking pictures of those parts of the installation that are not normally open to the public.
4) If a passenger wishes to take pictures for commercial reasons they should ask for written permission first. Commercial use includes:
a) Illustrating books or publications;
b) Use of the operator’s registered images on souvenirs or gifts;
c) Use of the operator’s registered images in advertising; and
d) Publication on commercial web sites.
L. Dogs
1) All dogs are carried free of charge, provided that they are kept under control and on a lead.
2) The operator reserves the right to refuse carriage of any dog that displays bad behaviour towards other dogs or passengers.
M. Queries and Complaints
All queries and complaints should be taken up with the operator at the time of travel. Any that cannot be resolved during the visit should be addressed in writing to The Central Tramway Company, 1 Marine Parade, Scarborough YO11 2ER, or via e mail to info@centraltramway.co.uk.

These Conditions of Carriage were issued on 21st September 2018 and supersede all previous issues.
